Colorado gets its share of weird events that end up in criminal arrests. One of those occurred Friday evening, Oct. 28, when a 32-year-old woman who was handcuffed and sitting in the rear of a deputy’s SUV managed to slip out of her handcuffs and bust through the barrier to the front seat. The outcome leaves her facing a slew of criminal charges against which she must wage a monumental defense.
The El Paso County Sheriff’s Office had taken the woman into custody on alleged drug charges and had just placed her in a deputy’s SUV. Apparently, the officers were not in the SUV when the woman did two seemingly super-human things: getting out of the handcuffs and busting out the barrier to the front seat. She then allegedly led officers on a short chase to a point in front of the University of Colorado at Colorado Springs.
She was taken again into custody, ending up with charges that include parole violation, attempted escape, first-degree aggravated motor vehicle theft, vehicular eluding, resisting arrest, reckless endangerment and reckless driving. The nature of the original drug offenses or the charges in that respect are unclear. She was taken to the Criminal Justice Center and held without bond. Even accepting the sheriff’s description of the woman’s antics, the authorities piled on the charges, most likely to teach her a strong lesson.
However, criminal defense counsel owes the client the strongest defense possible under the circumstances. A seasoned criminal defense attorney in Colorado who is familiar with the prosecutors and their policies will likely succeed in negotiating a plea that is absent several of the charges listed. The charges are in many respects duplicative and possibly unsupported by the right kind of evidence. In addition, counsel will likely plead for an alternative disposition for her in that she suffers from emotional and mental conditions that need treatment as opposed to harsh punishment.
